Terms of Service

Chapter 1 Generals

Article 1 Objectives

These terms and conditions of Famecs (“Company”) specify the conditions and procedure of using all services provided by the website in compliance with the Telecommunications Business Act and its enforcement decree.

Article 2 Definitions

“Users” are members and non-members who get the services provided by the website according to these terms and conditions when they are connected to the website.

“Members” are those who are registered as members by providing their personal information to the website. They are continually provided with the information from the website, and can use the services provided by the website.

“Non-members” are those who are not registered as the members but use the services provided by the website of the Company.

Article 3 Effect and changes

The Terms and Conditions take effective when they are posted on the initial service screen of the website of the Company for information of the users.

The Company may change the Terms and Conditions if there is any change in the situation or operation as long as the change does not violate the Act on the Regulation of Terms and Conditions and related laws. In this case, the changes shall be specified along with the date of application, cause of revision and contents of changes and they shall be posted on the initial service screen of the website from 7 days prior to the application date to the date immediately prior to the application data.

The terms and conditions which are changed according to 2 above take effective in a way specified in 1 above.

Article 4 Rules other than terms and conditions

Any matters not specified in the terms and conditions shall follow the related laws as long as they are described in them.

Chapter 2 Membership and use of services

Article 1. Making the service use agreement

The agreement on the use of the service on the Company’s website is made when a user applies for the use of the services, the Company accepts the application and the User expresses his agreement on these Terms and Conditions.

If the Company accepts the user’s application for the use of the services on the website, the Company shall inform the user of the member ID and others which the Company thinks are required.

The Company does not accept the application for use of the service in any of the followings.

  • a. When the application is made in the name of other person,
  • b. When the applicant does not use his own real name,
  • c. When the application form was falsely filled in.
  • d. When the application is made with the purpose of damaging the order or stability of the community
Article 2 Use and restricted use of services

The service on the company’s website is available in 24/7, 365/a year as long as there is no problem in the operational or technical matters in the Company.

The use time of the service specified above may be restricted with the prior notice to the members if the restriction is required due to the regular checking/replacement of the information and communication system.

In case of the suspension of the service specified in 2 above, the company may give the notice to each members via email address or for unknown many members, replace the individual notice with the posting it on the bulletin board for more than 1 week.

Chapter 3 Obligations

Article 1 Obligations of the Company

The Company shall make the service available to the member at the date when the applicable service starts unless otherwise specified.

The Company is liable to provide the service in a continual and stable way as specified in the Terms and Conditions.

The Company shall handle the opinion presented by the members according to the specified procedure and if a certain period is required to handle, it shall inform the members of the cause and delay and the schedule.

The Company shall keep the information on members confidential and shall use it for the purposes of operating the quality service and improving the service including the introduction of the Company. It shall not use it for purposes other than specified here nor assign it to any third group or entity.

Article 2 Obligations of member

The member is responsible for controlling his ID and password.

The member shall not allow any third person to use his ID and password.

If the member thinks that his ID or password is stolen or is used by a third party, it shall inform the Company of the fact.

The member shall comply with the matters specified in the Terms and Conditions and the related laws.

The user shall not act the followings.

  • Registration of false contents in case of application or changes
  • Change in the information posted on the Company’s website
  • Transmission or posting of the information other than described in the Company’s website
  • Infringement of intellectual property rights such as Company’s website or other third party’s copyright
  • Acts which would defame the prestige of the Company or a third party or inhibits its works
  • Acts which disclose or post the obscene or violent message, movie, sound or information which is in violation of public order

Chapter 4 Termination of service use or restriction of its use

Article 1 Termination of service use or restriction of its use

If a member wants to terminate the service use agreement, he shall apply for the termination of the service use agreement on the Famecs’ website. In this case, the member shall enter his name, ID and password and use the termination menu on the website before selecting the “terminate the membership”.

If a member wants to terminate the service use agreement, the member shall enter his name, ID and password. If he selects the “terminate the membership” on the menu of termination, the service use agreement is terminated.

If you cannot log in using the ID or password, it means you’re your membership is stopped or the service use agreement is terminated. Once ID is terminated, it cannot be used again.

If a member is put into one of the following cases, the Company may terminate the service use agreement or stop the service for a significant period without prior notice.

  • a. if the member is in violation of public order or good tradition
  • b. if the member gets involved in criminal acts
  • c. the member uses the service with the purpose of damaging the national interest or social benefits
  • d. the member steals the ID and password from others,
  • e. the member defames the other persons or gives disadvantages to them
  • f. the same user makes the dual registration with different ID,
  • g. the man obstructs the sound use of the service,
  • h. the man violates the related laws or the conditions of use specified by the Company.
Article 2 Procedure for lifting the restricted use of service

If the Company plans to restrict the use of service, it shall designate the cause, date and time and inform them to the member or agent using the mail or telephone. If the Company urgently needs to stop the service, it may restrict the service without conducting the notice described above.

If the member or his agent is notified of the news on the stop of the service as described above, he may file a claim on the stop of the service.

If the cause of stopping the service is confirmed to have been removed, the Company shall immediately life the stop of the service.

(Additional provision) The terms and conditions take effective on May 1, 2018.

Privacy Policy

Generals

Famecs establishes the handling policy as follows in order to comply with the regulation on the protection of personal information according to the Act on Expansion of Dissemination and Promotion of Utilization of Information System and Personal Information Protection Act, protect the customer’s personal information and benefits according to Article 27-2 of Act on Expansion of Dissemination and Promotion of Utilization of Information System and smoothly handle the customer’s complaints related to the personal information.

  • Famecs will make the public notice (or individual notice) of its policy on the handling of personal information through the website of Famecs (http://www.famecs.com))
  • The customer is recommended to check our policy on the handling of personal information time to time by visiting the website of Famecs.
  • If there is the difference between this policy on handling the personal information and the individual policy on handling of personal information for each business department, the individual policy on handling of personal information for each business department takes precedence.
  • If you do not want to get your personal information to get collected, used or assigned (“handled”) as follows, you may not agree on the handling. Provided that if you fail to agree on the individual policy on handling of personal information for each business department, you may not use the whole or a part of the services.
1. Purpose of handling the personal information

The policy on the handling of personal information has critical implications as follows.

  • It transparently shows how Famecs gathers what information, how the gathered information is used, with whom it is shared (to who it is provided) and when and how the information whose goal of retention has been achieved is destroyed.
  • It also shows what right the user has as the owner of the information, and what method and procedure he can exercise that right.
  • If there is any infringement of personal information, it shows how the additional damage can be prevented, to whom the contact should be made and what kind of assistance can be acquired to recover the damage already done.
  • Most of all, it defines the rights and obligations on personal information between Famecs and the user and becomes the means to ensure that the user has the right of determining his own personal information.
2. Items of personal information to be handled
  • The user can use most of the Famecs services such as search of product or industry group, forum and corporate information in the same way as members without joining the membership.
  • If the user gets the membership to use the personalized or membership services such as data download, My Page, Technical Support and questions Famecs collects the minimum personal information required for the use of services.
  • In the time of joining the membership, Famecs collects the following personal information form the applicant.

      - In the time of joining the membership, Famecs gathers the required information such as member’s ID, password, name, email, cell phone number (dual joining checking information CI/DI), mobile carrier information and telephone number. Also as the optional information, Famecs collects the ‘contact point, address, work information, mobile number, department, workplace/school, department and staff/specialty.

      Your mobile phone number is using a phone number that is certified by the NICE Information Service.

  • The following personal information is collected from the users in the process of using the service.

3. How to gather the personal information
  • Famecs gets the consent of the user at its website according to the procedure for the consent on the collection of personal information when it tries to gather the personal information which can be traced back to the user.
  • Famecs makes the public announcement of any matters related to the collection of personal information through its privacy policy or terms and conditions in its website. If the member click “Agree” on the contents above, he is considered to have agreed on the collection of personal information.

4. Handling and retention period of personal information

The website of Famecs destroys the member’s personal information without delay as soon as the goal of collection of personal information is achieved.

But, if the personal information needs to be retained according to the laws including Commercial Act even if its goal is achieved, the Company may retain the member’s personal information.

  • If the laws including Commercial Act require it to be retained,
  • Records on the customer’s complaints and dispute handling: 3 years
  • The retention period has been notified to the members or specified through fair process
  • The personal consent of the member is acquired

5. Delegation of handling the personal information
  • Famecs does not provide the personal information to any third parties without the user’s consent except the followings.
    • The member makes the prior consent.
    • The user consent on the provision of personal information to use the service of the outside supplier.
    • It is performed according to the laws, the procedure and method specified in the law for the purpose of investigation or as asked by law reinforcement agency.
  • Famecs delegates some works to the outside service provider for the provision of service and specifies the matters for the outside service providers’ safe handling of the personal information according to the related laws.

  • Among the works delegated to the outside service providers, the following works are delegated to the overseas service providers. Famecs does not provide the user’s personal information to overseas service providers except the storage of data and operation of service. The following companies are all overseas companies of Famecs and protect the user’s information according to the information protection policy which is the same with that of Famecs and conduct the work under the control of head office of Famecs.

6. Provision of personal information to any third parties

The website of Famecs does not provide the user’s personal information to the outside except the followings.

  • The user makes the prior consent.
  • The provision is made according to the law or to the procedure and method specified in the laws for the purpose of investigation.
7. Destruction of personal information

1. Procedure of destruction

The information provided by the members for joining would be stored for a certain period of time according to the internal policy or other information protection laws once its goal is achieved before being destroyed. The personal information would not be used for purposes other than specified in the related laws.

2. Destruction method

  • The personal information printed out in paper: complete destruction (incineration or destruction, etc.), deletion using the dedicated incinerator
  • Personal information stored in the form of electronic file: initialization or overwriting so that the data cannot be recovered
  • If the part of the personal information shall be destroyed by administrator and the method specified in 1 is hard to perform, the following actions shall be taken.

a) In case of electronic file: once the personal information is deleted, it shall be controlled in a way that it cannot be recovered.

b) In case of the records, prints, document or other media other than specified in 1 above: delete it with masking or punctuation.

8. Rights and obligations of information subject and method of exercising it

The customer may exercise the following rights as the information subject

1. Request for access to personal information.

You can ask us to show the personal information file kept by Famecs according to Article 35 (5) of (Access to personal information) of Personal Information Protection Act. The access may be restricted according to Article 35 (5) of the Act in the following cases even if asked for the access to the personal information.

  • When the access is prohibited or restricted according to the laws.
  • The access may the other person’s life or body or unfairly damages other person’s properties or benefits.

2. Request for correction or deletion of personal information

You may ask Famecs to correct or delete the personal information file according to Article 36 (Correction or erasure of personal information) of Personal Information Protection Act unless the information is specified to be kept under other laws.

3. Request for suspension of processing the personal information.

You may ask Famecs to suspend the processing of the personal information file kept by Famecs according to Article 37 (Suspension of processing of personal information) of the Personal Information Protection Act. If the request for suspension the processing of personal information is made, the request may be rejected according to Article 37 (2) of the Act.

  • Where special provisions exist in law or it is inevitable to observe legal obligations
  • Where it may probably cause damage to the life or body of a third party, or improper violation of property and other benefits of a third party
  • Where the data subject fails to express explicitly termination of the contract even though it is impracticable to perform the contract such as provision of service as agreed upon with the said data subject without processing the personal information in question.

4. Protection of personal information for children of below the age of 14

  • Famecs does not gather the personal information on children below the age of 14
  • If the personal information of children below the age of 14 is to be acquired due to some reasons, Famecs will try to get the consent of the legal representative of the children. Once the related work is finished, the information would be destroyed without delay and while the work is under processing, the personal information will be properly handled.
  • The legal representative of the children with the age of below 14 may ask Famecs to access to, correction, deletion or suspension of process the children’s personal information.
  • If you want to access, correct, delete, suspend the process or revoke the consent of personal information and contact the related department or person in charge of personal information in letter, phone or email, we will check the identity of caller and take proper action.
  • If you ask us to correct any errors in personal information, we would not provide the personal information until the correction is completed. In addition, if the personal information having error has been already provided to any third party, we will notify that to the third party and take proper corrective actions.
  • We hope that you make the input of updated information to prevent inadvertent accidents. Any accident arising from the input of incorrect information would be borne by the customer himself and if any faulty information is entered such as theft of other’s information, the membership may be lost or the use of service may be restricted.
  • You have both the right of your personal information being protected and the duties of not infringing other person’s personal information.

Take precaution so that your personal information is not disclosed and you do not infringe the personal information of other people including the postings.

If you violate these duties such as theft of other’s personal information or input of faulty information, your service may be suspended or you may be punished according to the related laws.

9. Actions for safety of personal information

Famecs takes the technical, administrative and physical actions for the safety as follows according to Article 234 (2) and 29 of Personal Information Protection Act and Article 30 of Enforcement Decree of the Act so that the customer’s personal information is not lost, stolen, leaked, changed or damages as follows. Provided that if the personal information is disclosed due to the customer’s carelessness or Internet’ problem, Famecs does not bear any responsibility.

  • Famecs prepares the regulation on the protection of personal information and have the staff members to understand it and comply with it.

  • Famecs prepares the internal procedure to monitor the compliance with the policy of processing (handling) the personal information and implement it on a continual basis. If any problem is found through the organization dedicated for the protection of personal information, it takes the immediate corrective actions.
  • If Famecs handles the user’s personal information using the computer, it designates the persons for accessing to the personal information and grants the ID and password to them, which are revised on a regular basis.
  • Famecs causes the new staff members to sign on the statement of the protection of personal information in recruiting the new members. In case of retirement, the Company makes the retiring staff members not disclose, damage or infringe the personal information obtained during the work.
  • The transfer of the work by the person in charge of personal information is conducted in the secure situation and the responsibility of the accident related to the infringement of personal information is clearly defined after entering or quitting the company.

2. Technical actions

  • Famecs takes the action to prevent the computer virus or hacking from infringing the personal information using the latest vaccine program.
  • Famecs controls the unauthorized access from the outside and protect the intracompany network using the invasion blocking system. For the guarantee of security, Famecs makes every effort to have all kinds of possible technical devices.
  • Famecs strictly encrypts the critical personal information such as ID for storage and control.

3. Physical actions

  • Famecs sets the computer room and data room as the special restricted area and strictly controls the access to them.
  • Famecs operates the web server and store the contents at a safe third place. By setting the place as the special protection area, it strictly controls the access to them by any person except the authorized personnel.
10. Collection of personal information by cookies

Famecs’ website uses the cookie in order to store and find out the member’s information time to time.

Cookie is the very small text file which is used to operate the website of Famecs and which is sent by the server to the member’s browser and is stored in the hard disk.

The website of Famecs uses the cookies for the following purposes.

  • We analyze the frequency of access and access time for members and non-members and try to understand the user’s preference and field of interest, thus using the information for the target marketing and improvement of services.
  • At the event sponsored by Famecs’ website, the information on the participation and visit frequency are collected and the opportunity for differentiated application is granted depending on the field of interest and used for the provision of differentiated information.
  • The member has the option of installing the cookies. Accordingly, the member may allow all kinds of cookies to be stored by setting the option at the web browser, undergo the identification process whenever the cookie is stored or reject the storage of all kinds of cookies.

11. Transmission of advertising information
  • Famecs does not transmit any advertising information for the operational income without the prior consent of the customers.
  • When the Company transmits the push message for the smart phone (which is the advertising information) for the customer oriented marketing such as information on new contents or event information, the company would get the consent of the customers, marks the title of message with the word (advertising) in order to help the customer that he message has the advertising.
  • If the advertising information is transmitted such as the email or SNS to the customers who agreed on the receipt of the message, the company takes the necessary actions such as marking the name of transmitters.
12. Person for protection of personal information

Famecs appoints the persons in charge of protection of personal information to protect the customer’s personal information and handle the customer’s complaints on the personal information. If you have any question on personal information, call the officer, manager or staff in charge of personal information protection. Any question on the website may be made to the administrator of the website.

13. Department receiving and handling the application for review of personal information

If your right on personal information is infringed or you need a consulting, you can call one of the following organizations.

15. Change in the personal information processing policy

This personal information processing policy is revised on May 1, 2018. If there is any change in the policy such as addition, deletion or amendment due to the change in the internal policy or security technology, we will give at least 7-days prior notice on it by posting the cause and contents of changes on the website. Provided that if there is a change in the significant contents such as provision of personal information to any third parties, change in the purpose of use or collection or the retention period, we will get the consent of the customers.
